Effective October 19, 2026 · Version 2026-10-19
Terms of Service
Who these terms cover. These Terms are an agreement between you and Martin Services, the operator of PorchTunes. They apply only to the PorchTunes service and do not govern another product, company, or organization.
1. Acceptance and eligibility
By creating an account, purchasing or using credits, submitting material, generating or downloading content, or otherwise using PorchTunes, you agree to these Terms and the Privacy Policy, Acceptable Use & AI Music Safety Policy, and Credits, Billing & Refund Policy. If you do not agree, do not use PorchTunes.
You must be at least 18 years old, be a resident of the United States, and be able to enter a binding agreement. By creating or using an account, you represent that you satisfy these eligibility requirements. If you use PorchTunes for a client, employer, artist, label, or other party, you represent that you have authority to act for that party.
2. Accounts and access
You must provide accurate information, protect your sign-in credentials, and promptly report suspected unauthorized access. You may not sell, rent, share, transfer, or sublicense an account, license key, subscription, credits, promotional code, or access right without written permission from Martin Services. You may not create multiple accounts or use false information, a proxy, or automation to evade limits, pricing, sanctions, geographic restrictions, or enforcement.
Where PorchTunes offers Parental Controls, they are supplemental tools for an authorized adult to manage content, purchasing, voice, and related account features. They may reduce access to some material or actions, but no automated control can identify or block every unsuitable request, response, or use. Parental Controls do not replace active parent or guardian supervision, and adult supervision is always recommended. Availability of these controls does not change the minimum-age or eligibility requirements above or by itself authorize use by a minor.
3. Your input and responsibilities
“Input” includes prompts, lyrics, titles, descriptions, audio, voices, recordings, files, images, and metadata you provide. “Output” includes music, sound recordings, compositions, lyrics, text, timing information, artwork, metadata, and other material generated or transformed through PorchTunes.
You are responsible for your Input, your instructions, and every use of Output. You represent that you have all rights, permissions, consents, releases, and authority needed for Martin Services and its service providers to process your Input and for your intended publication, distribution, synchronization, promotion, monetization, or other use of Output. Do not submit copyrighted lyrics, recordings, samples, performances, artwork, confidential information, personal information, or a person's voice or likeness unless you are authorized to use it.
Real people's faces and voices
Before you add a real person's photo, video, or voice, you must be that person or have their clear permission to use their face or voice for the content you are making. For a minor, you must be their parent or legal guardian or have that parent's or guardian's permission. You may not use the face or voice of a deceased person, a celebrity, an artist, or a public figure unless you hold the rights to do so. Martin Services may ask you to show this permission and may remove content or restrict features if you cannot. If the person withdraws permission, you must stop using and delete the content.
4. Output and commercial-use license
Output is created with automated and artificial-intelligence systems. It may be incomplete, unavailable, inaccurate, unusable, similar to output created for another user, or subject to third-party claims. Martin Services does not promise that Output is unique, copyrightable, non-infringing, cleared for every use, eligible for copyright registration, or accepted by a distributor or platform.
Subject to payment of applicable fees and your compliance with these Terms, Martin Services grants you a worldwide, non-exclusive license to reproduce, distribute, publicly perform, communicate, synchronize, modify, and commercially use eligible paid PorchTunes Output generated through your account. This license does not give you rights in third-party material, another person's voice or likeness, Martin Services or PorchTunes branding and technology, or Output created or used in violation of these Terms.
Unless PorchTunes states otherwise when you generate it, Output created under a free, trial, beta, promotional, tester, or non-commercial offer is for lawful personal and non-commercial use only. Generative systems can produce similar results for different people; resemblance does not make another user's Output yours.
Labeling AI-made content
Output is made with AI. When you publish or share realistic video or audio of a real person, you must not present it as real footage or a real recording, and you must follow any AI-labeling rules of the platform where you post it. Do not remove a label or provenance information that PorchTunes adds.
5. Operational license and public sharing
You retain any rights you have in your Input. You grant Martin Services and its service providers a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, and technically transform your Input and Output only as reasonably necessary to operate, secure, support, troubleshoot, improve, and enforce PorchTunes or comply with law. Private Input and private Output will not be used to train general-purpose AI models unless you separately opt in through clear affirmative consent.
If you deliberately use a public-sharing feature, you also permit Martin Services to host, display, distribute, and promote that public content in connection with PorchTunes until you remove it or disable public sharing, subject to reasonable backup, security, legal, and enforcement retention.
6. Safe and lawful use
You must follow the Acceptable Use & AI Music Safety Policy. In particular, you may not infringe rights; imitate or clone a real person's voice without permission; falsely imply endorsement or participation; generate unlawful sexual, exploitative, hateful, excessively violent, fraudulent, or deceptive material; manipulate engagement metrics; bypass safeguards or payment controls; attack the service; resell access; or use PorchTunes to develop a competing model or service without written permission.
7. Credits, payments, refunds, and taxes
Credits are account-based digital entitlements, not money, and have no value outside PorchTunes. They may not be sold, pooled, transferred, or converted to cash except where law requires. Prices, credit quantities, and any applicable tax are shown before payment. Purchases are processed through a third-party hosted checkout; Martin Services does not intentionally receive or store your full card number.
Video features use credits for each step you approve, such as song analysis and story, character portraits, scene pictures, scene videos, and lip sync. The credits are shown before you approve and charged when the step starts. A step that does not produce its result is refunded automatically.
To keep the service fair and secure, PorchTunes may limit how much one account can create or store, such as the number of active projects, simultaneous video jobs, daily generations, or saved media, and may pause requests that look automated or abusive. Limits that apply to you are shown in the app when you reach them.
Payment, failed-generation, refund, dispute, and negative-balance rules are stated in the Credits, Billing & Refund Policy. A subjective preference about an otherwise usable Output is not itself a service failure.
8. Service operation and enforcement
PorchTunes may rely on third-party authentication, cloud, storage, payment, moderation, audio, and AI services that have their own terms and availability. Martin Services may reject Input, limit generation, remove or disable Output, restrict features, suspend or terminate accounts, revoke improperly obtained credits or access, preserve relevant records, and report suspected unlawful conduct when reasonably necessary for safety, rights enforcement, fraud prevention, security, or legal compliance.
9. United States service; unauthorized international use
PorchTunes is operated from the United States and is offered only to United States residents. It is not offered, marketed, localized, or cleared for account use or purchase by residents of another country. A person outside this eligibility scope may view public informational pages, but may not create or use a PorchTunes account, purchase a subscription or credits, or generate, download, publish, or distribute Output through the Service. Any such activity is unauthorized and violates these Terms.
PorchTunes does not promise that technical controls will identify or block every ineligible access attempt. Failure to block an attempt, or acceptance or processing of an attempted transaction before the ineligibility is discovered, does not waive this restriction. Martin Services may suspend or terminate an ineligible account, reverse or cancel access or entitlements as permitted by law, preserve records needed for fraud, payment, security, tax, dispute, or legal purposes, and take other reasonable enforcement action. You remain responsible for every law and requirement applicable to your access, Input, Output, privacy, taxes, advertising, intellectual property, disclosure, distribution, and monetization. You may not use PorchTunes in violation of United States export-control or sanctions laws or to benefit a restricted party.
10. Intellectual property and feedback
The PorchTunes service, software, models, designs, interfaces, names, logos, text, and technology are owned by Martin Services or its licensors. Except for the limited Output license above, no right or interest is granted. Feedback you voluntarily provide may be used by Martin Services without restriction, attribution, or compensation.
11. Disclaimers
To the maximum extent permitted by law, PorchTunes and Output are provided “as is” and “as available.” Martin Services disclaims express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, accuracy, availability, security, quiet enjoyment, and non-infringement, and does not promise uninterrupted, error-free, safe, unique, or rights-cleared service or Output.
PorchTunes does not provide legal, copyright, music-licensing, tax, distribution, financial, medical, or other professional advice. You must obtain qualified advice and rights clearance when needed.
12. Limitation of liability
To the maximum extent permitted by law, Martin Services and its owners, licensors, service providers, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; lost profit, revenue, data, or goodwill; business interruption; substitute-service costs; or claims arising from Input, Output, third-party services, account access, service interruption, or your use or inability to use PorchTunes.
To the maximum extent permitted by law, total aggregate liability for all claims arising from PorchTunes or these Terms will not exceed the greater of the amounts you paid to PorchTunes during the 12 months before the event giving rise to the claim or $100. Nothing here excludes liability that applicable law does not permit to be excluded.
13. Indemnification
To the maximum extent permitted by law, you will defend, indemnify, and hold harmless Martin Services and its owners, licensors, service providers, officers, employees, contractors, and agents from claims, losses, liabilities, penalties, judgments, and reasonable legal expenses arising from your Input or Output; your breach of these Terms; your publication, marketing, distribution, monetization, or other use of Output; your infringement of third-party rights; unauthorized use of a person's voice, likeness, identity, private information, or confidential information; fraud or illegal activity; or failure to comply with laws and rules applicable to you.
14. Suspension, termination, and changes
You may stop using PorchTunes at any time. Martin Services may suspend or terminate access when it reasonably believes you violated these Terms, created legal or security risk, failed to pay, engaged in fraud or abuse, or when action is required by law. Provisions that should survive by their nature—including ownership, restrictions, disclaimers, liability limits, indemnification, and international-use obligations—remain effective.
Martin Services may update these Terms by posting a revised version with a new date and may provide additional notice for material changes. Continued use after the effective date constitutes acceptance to the extent allowed by law.
15. General terms and contact
These Terms and the linked policies are the entire agreement about PorchTunes. If a provision is unenforceable, the remaining provisions stay effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without written consent; Martin Services may assign them in connection with a restructuring, financing, or transfer of the PorchTunes business or assets.
