Acceptable Use & AI Music Safety

Who this policy covers. This Policy governs people using PorchTunes, which is operated by Martin Services. It applies only to PorchTunes and does not govern another product, company, or organization.

1. Core rule

Use PorchTunes only for lawful, authorized, respectful, and non-deceptive music creation. You are responsible for having every right and permission needed for your Input and every use you make of Output.

2. Prohibited content and conduct

You may not use PorchTunes to:

• Upload, reproduce, transform, or distribute copyrighted lyrics, recordings, samples, stems, compositions, performances, artwork, or other protected material without permission.
• Request, create, distribute, or market content falsely represented as created, performed, approved, sponsored, or endorsed by a real artist, singer, songwriter, producer, celebrity, public figure, label, or brand.
• Clone, simulate, imitate, or create a confusingly similar version of a person's voice, likeness, identity, or performance without prior, express, informed, documented permission.
• Create fake endorsements, fabricated interviews or evidence, fraudulent calls, scams, phishing, deceptive advertising, false testimonials, impersonation, or political persuasion content involving a real person's voice or likeness.
• Generate or promote unlawful, fraudulent, defamatory, invasive, harassing, threatening, hateful, cruel, sexually exploitative, excessively violent, or otherwise harmful content.
• Generate sexual content involving anyone under 18, sexualize minors, facilitate grooming, or endanger minors in any way.
• Promote or facilitate unlawful violence, terrorism, weapons wrongdoing, criminal activity, self-harm, exploitation, blackmail, stalking, doxxing, or exposure of private or sensitive information.
• Manipulate streams, charts, likes, views, listeners, social engagement, or other metrics using bots, account farms, fake activity, or deceptive campaigns.
• Evade filters, moderation, account limits, age controls, rate limits, payment or credit controls, geographic restrictions, export controls, sanctions, or enforcement.
• Use scraping, data mining, bots, automated account creation, credential sharing, abusive automation, malware, or unauthorized API or system access.
• Interfere with, overload, damage, probe, reverse engineer, decompile, copy, extract, benchmark, or attempt to discover PorchTunes source code, models, prompts, datasets, algorithms, system behavior, or proprietary technology except where law expressly permits.
• Use PorchTunes, Output, or service data to develop, train, fine-tune, evaluate, benchmark, or improve a competing product or AI model without written permission.
• Resell access, accounts, credits, subscriptions, promotional codes, or features without written permission.
• Remove or bypass a watermark, fingerprint, metadata field, AI label, or provenance marker applied by PorchTunes.

3. Real artists and safer prompting

Describe general musical qualities rather than requesting imitation of an identifiable person. A request for “warm 1970s roots-rock, acoustic guitar, close harmonies, reflective storytelling, and restrained drums” is acceptable. A request to make a new track sung exactly as a named living singer or falsely presented as an unreleased song by a real band is not.

4. Voice uploads

You may upload only your own voice or a voice for which you have written permission specifically authorizing use through PorchTunes. Martin Services may request proof of consent and may reject, remove, restrict, or disable voice-related Input, Output, or features.

4A. Photos, faces, and videos of real people

You may use a real person's face or voice only if you are that person or have their permission. You may not use PorchTunes to:

• Create nude, sexual, or sexually suggestive images or videos of a real person, or share intimate images of anyone without their consent.
• Include a minor except as their parent or legal guardian, or with that parent's or guardian's permission, and only in family-appropriate content. Content that sexualizes, endangers, mocks, or bullies a minor is never allowed.
• Make realistic videos that show a real person saying or doing something they did not say or do in order to deceive, harass, embarrass, defraud, or influence an election, or that impersonate a public official.
• Show a real person in violent, humiliating, criminal, medical, or other sensitive situations without their permission.
• Use photos of strangers, or photos taken from social media or the internet, of people who have not agreed.

PorchTunes may check uploads and requests automatically, may refuse a photo or request, and may ask you to show permission.

4B. Fair-use limits

To protect the service and other customers, PorchTunes may limit each account's projects, simultaneous video jobs, daily generations, and saved media, and may slow or pause activity that looks automated, shared, or abusive. Do not try to get around these limits with multiple accounts or automation.

5. Public content and community rules

Keep content private by default. You are responsible for content you deliberately publish or share. Public content may be viewed, copied, shared, or indexed outside PorchTunes. Removing it from PorchTunes cannot recall copies already made elsewhere.

Do not publish content that infringes rights, impersonates a person, falsely claims artist involvement, exposes private information, harasses anyone, promotes fraud, contains unlawful material, or violates these rules. Martin Services may remove public content, restrict sharing, disable links, suspend accounts, preserve records, or report activity when reasonably necessary.

6. Enforcement

Martin Services may block Input, remove or disable Output, limit access, cancel credits obtained or used through abuse, suspend or terminate accounts, preserve records, and cooperate with rights holders, platforms, payment providers, or authorities. Serious violations—including child exploitation, credible threats, fraud, unauthorized voice cloning, or attempts to compromise the service—may result in immediate permanent termination and reporting. Repeated lesser violations may progress from a warning to restriction, suspension, and termination. A blocked or removed request may be ineligible for credit restoration.

7. Parental Controls and adult supervision

Where available, Parental Controls can help an authorized adult restrict mature prompts or generated content, purchases, voice features, and future social features. These controls are designed to add a layer of protection, not to guarantee that every inappropriate word, theme, response, or attempt will be detected or blocked. They are not age verification and are not a substitute for a parent or guardian reviewing how PorchTunes is used. Adult supervision is always recommended, and users may not bypass, disable, discover, or reset another person's parental PIN or restrictions without authorization.

8. Eligibility, international access, and reporting

PorchTunes accounts, purchases, and account features are offered only to United States residents. Creating or using an account, purchasing, generating, downloading, publishing, or distributing Output through PorchTunes outside that eligibility scope is unauthorized, even if a technical control does not block the attempt. Ineligible access may result in restriction or termination under the Terms of Service. To report suspected violations, copyright concerns, or unsafe public content, use the PorchTunes Support page.

A person shown in PorchTunes content without permission, or that person's parent or guardian, may ask us to remove it. Valid reports of non-consensual intimate images, including AI-made ones, are removed within 48 hours, and we make reasonable efforts to remove identical copies.
