Privacy Policy

Who this policy covers. This Policy describes personal information handled by Martin Services when it operates PorchTunes. It applies only to PorchTunes and does not govern another product, company, or organization.

TermsPrivacySafetyBilling & refundsSupport

1. Scope

This Policy applies to visitors, account holders, people who submit prompts, lyrics, audio, or other content, people who generate or download Output, purchasers, and people who contact PorchTunes. Third-party websites and services have their own privacy practices.

2. Information we collect

Account and identity information

Name, email address, account ID, Firebase-issued user ID, sign-in provider, profile details, age confirmation, account status, and location or billing information you provide.

User content and generation information

Prompts, lyrics, titles, descriptions, tags, audio or voice uploads, samples, stems, files, generated music, generated lyrics, artwork, generation settings and records, downloads, Library records, and credit use.

Photos, faces, and voices

If you use video or voice features, the photos, video clips, and voice or singing recordings you choose, the descriptions you give the people in them, your confirmation that you have their permission, and the videos and audio made from them. See section 4A.

Payment and transaction information

Purchase ID, package or plan, amount, currency, credit quantity, purchase/refund/dispute status, payment-processor customer and transaction identifiers, and billing location. PorchTunes does not intentionally collect or store full card numbers, security codes, or full payment credentials; those are entered on the payment processor's hosted page.

Communications and technical information

Support messages and attachments, safety and copyright reports, appeals, browser and device type, operating system, IP address and approximate location, page and feature activity, session data, security signals, error reports, and logs. Authentication, payment, cloud, storage, AI, audio, moderation, and security providers may also return information needed to operate the service.

3. How we use information

  • Provide, operate, secure, maintain, troubleshoot, and improve PorchTunes.
  • Process Input and return music, lyrics, artwork, and other Output.
  • Administer accounts, entitlements, credits, purchases, refunds, and disputes.
  • Communicate about service, account, purchase, security, and support matters.
  • Send PorchTunes news, feature updates, and offers only when you separately opt in to marketing email. Account creation and purchase agreement are not marketing consent.
  • Detect and prevent fraud, abuse, infringement, unauthorized access, and safety incidents.
  • Enforce agreements, comply with law, and protect users, Martin Services, and others.
  • Analyze aggregated or de-identified technical and product performance.

4. AI processing and private content

PorchTunes sends the Input needed for a requested feature to authorized infrastructure, AI, model, API, audio-processing, moderation, storage, or technical providers so they can process the request and return Output. Martin Services will not use private prompts, private lyrics, private audio or voice recordings, or private generated Output to train or improve general-purpose AI models unless you separately and affirmatively opt in through clear consent.

If you choose to publish content through a public-sharing feature, it may be viewed, copied, shared, indexed, or otherwise used by people outside PorchTunes according to the setting you choose.

4A. Photos, faces, and voices

What we use them for. When you ask PorchTunes to make a video or a song with a real person's face or voice, we use the photos, clips, or recordings you choose only to make, show, store, and deliver what you asked for, to keep it secure, and to enforce our policies. They are sent to the processing providers needed for that request, who may analyze facial features or voice characteristics only to perform it.

What we do not do. We do not use them to identify or recognize people, we do not build a database of faces or voiceprints, we do not sell or rent them or share them for advertising, and we do not use them to train general-purpose AI models.

Consent. Before you add a real person's face or voice, you must confirm that you are that person or that you have their permission (for a minor, permission from their parent or legal guardian). Your own voice is used only after you give your own spoken and written consent. You can withdraw consent at any time by deleting the photo, clip, voice, or project.

How long we keep them. Photos, clips, and voice recordings you add, and the videos made from them, are kept while they are in your account. When you delete them, the project, or your account, they are removed from active use right away and permanently deleted from our storage within 30 days, except for backups, which expire on their normal schedule, and records we must keep for safety, legal, or dispute reasons. In any case, we do not keep source photos or voice recordings more than 3 years after your last use of PorchTunes.

Your voice model. If you create a voice model of your own singing voice, deleting that voice or your account removes it from PorchTunes right away, and we have the voice model deleted from the processing provider that holds it.

Sensitive information. Where state law treats face or voice data as biometric or sensitive information, we use it only for these purposes and only with your consent, and we honor the request and deletion rights in sections 9 and 10.

AI labels. Videos and audio made with PorchTunes may carry a visible label or hidden provenance information that shows they were made with AI.

5. How we disclose information

Information may be disclosed to service providers that supply hosting, storage, authentication, payment processing, AI and audio processing, moderation, analytics, diagnostics, communications, support, security, fraud prevention, and professional services. It may also be disclosed when you direct or consent to sharing; in connection with a financing, restructuring, or transfer of the PorchTunes business; or to authorities, rights holders, payment providers, platforms, or other parties when reasonably necessary to comply with law, investigate misuse, enforce policies, protect rights, or prevent harm.

Martin Services does not sell PorchTunes personal information for money and does not knowingly sell or share it for cross-context behavioral advertising. This Policy will be updated and required choices provided before that practice changes.

6. Browser storage and cookies

PorchTunes uses browser storage to keep you signed in, remember choices, maintain account-scoped consent, support updates, and operate features. Providers may use cookies, SDKs, logs, or similar technology for authentication, hosted checkout, security, fraud prevention, and service performance. Browser controls may limit some storage, but disabling it can prevent features from working. PorchTunes does not use third-party behavioral-advertising cookies.

7. Retention and deletion

Information is retained as reasonably necessary to provide PorchTunes, maintain your Library and credits, fulfill the purposes above, comply with legal and accounting obligations, resolve disputes, prevent fraud and abuse, maintain security, and enforce agreements. Account, generation, upload, payment, support, log, consent, refund, and safety records may have different retention periods.

For the one-time free-song offer, the account is deactivated after 7 days and the ordinary account profile and retained creative material are permanently deleted 30 days after the free song was created unless the user activates a paid subscription first. Paid customers keep full access through the end of their paid period; after paid access ends, the same 7-day deactivation and 30-day deletion timetable applies. PorchTunes does not claim ownership of an unpaid free-offer song merely because the account expires. Limited payment, tax, consent, security, fraud, dispute, and legal records may be retained when reasonably required for those purposes.

Video projects, scene pictures, clips, and finished videos stay in your account until you delete them. PorchTunes may set a storage limit per account and will tell you when you are close to it. Credit charges and refunds for video steps are kept with your purchase records.

Deleting an account does not necessarily remove records that must be kept for payments, taxes, consent, security, fraud prevention, dispute resolution, enforcement, backups, or legal compliance. Deleted information may remain temporarily in backups and logs. Customer songs, lyrics, and artwork are not deleted by another user; deletion is limited to the account owner or an authorized PorchTunes administrator acting for a legitimate support, safety, legal, or account request.

8. Security

Martin Services uses reasonable administrative, technical, and organizational safeguards, including access controls, authentication, encryption in transit, infrastructure protections, logging, monitoring, and vendor controls. No system is completely secure, and absolute security cannot be guaranteed.

9. Your choices and requests

Depending on applicable law, you may have rights to access, correct, delete, obtain a portable copy of, or restrict certain processing of personal information. Marketing email is off unless you affirmatively select it in Account & Settings. You may withdraw that consent there or through the unsubscribe option in every marketing email; withdrawal does not stop receipts, refund notices, security messages, support replies, or essential account correspondence. PorchTunes keeps a limited suppression record so a withdrawn address is not accidentally re-added. Marketing consent is specific to the verified email address and does not transfer automatically if that address changes.

PorchTunes does not sell marketing-contact details or provide them to another company for that company’s own marketing. A communications provider may process the address only to deliver messages for PorchTunes under appropriate service-provider terms. Submit other requests through the PorchTunes Support page. Identity verification may be required before a request is completed.

10. California notice

To the extent California privacy law applies, residents may have rights to know, correct, delete, opt out of sale or sharing where applicable, limit certain uses of sensitive information, and exercise rights without unlawful discrimination. In the preceding 12 months, PorchTunes may have collected identifiers, customer-record information, commercial information, internet or network activity, audio or electronic information, inferences from activity, and sensitive information voluntarily submitted by users or needed to secure accounts. These categories are used for the purposes described in this Policy. PorchTunes does not knowingly sell or share personal information for cross-context behavioral advertising.

11. Children

PorchTunes is not directed to children and is intended only for people at least 18 years old. Martin Services does not knowingly collect PorchTunes information from a person under 18. If it learns that an account holder is under 18, it may suspend the account and delete or restrict associated information subject to legal, security, and recordkeeping needs.

Parental Controls may be tested or offered as supplemental account-safety tools, but they are not age verification, proof of guardianship, or a substitute for active adult supervision. PorchTunes does not collect a child's exact birth date merely to operate these controls. A parental-control profile may store limited settings, PIN-security information, timestamps, and content-free security events as described by the feature; it is not intended to store blocked words, prompts, lyrics, recordings, or a child's separate identity. Offering or testing these controls does not change the age eligibility stated above. This Policy and the required consent process will be updated before PorchTunes knowingly offers a child-directed service.

An adult account holder may include a photo or recording of a minor only if they are that minor's parent or legal guardian or have that parent's or guardian's permission, and only for family-appropriate content. PorchTunes does not knowingly collect personal information directly from a child under 13. A parent or guardian may ask us to delete content showing their child through the Support page.

12. United States service and international access attempts

PorchTunes is operated from the United States and is offered only to United States residents. Residents of another country may view public informational pages but are not eligible to create or use an account, purchase subscriptions or credits, or use account features. If an ineligible person nevertheless attempts to access or use PorchTunes, information associated with that attempt may be transferred to, stored in, and processed in the United States and in other countries where service providers operate. Martin Services may use location, account, transaction, device, and security information to identify, investigate, and enforce eligibility, fraud, sanctions, safety, and legal requirements.

13. Reporting misuse of your image or voice

If you believe PorchTunes content shows your face or uses your voice without permission, or is an intimate image of you shared without consent, report it through the Support page. We remove valid reports of non-consensual intimate images, including AI-made ones, within 48 hours and make reasonable efforts to remove identical copies. Other likeness and voice reports are reviewed promptly.

14. Changes and contact

Martin Services may update this Policy by posting a new version and date and may provide additional notice where required. Material changes are listed in the change history below.
